Closed. Legal Counsel: Railway Sector Reform

A Reform Support Team (RST) at the Ministry of Infrastructure of Ukraine (MoI) is a group of Ukrainian professionals (non-civil servants) funded on a temporary basis by the EBRD multi-donor account, that provides targeted technical support and assists in the design and implementation of priority reforms. The RST will assist in filling the capacity gaps in the design and implementation of priority reform strategies and programs, while strengthening links and partnerships between the Ministry´s priorities and relevant donor support.  

Currently we are looking for  Legal Counsel: Railway Sector Reform.

Objective(s) and linkages to Reforms

Railway transport of Ukraine is the leading industry in the country's transport system, which provides 82% of freight and almost 50% of passenger traffic carried by all modes of transport. The operational network of railways of Ukraine is almost 22 thousand km, of which 45% is electrified. In terms of freight traffic, Ukraine's railways rank fourth in the Eurasian continent, second only to the railways of China, Russia and India.

The RST needs an industry-leading Legal Counsel with deep insight into the transport sector and unparalleled expertise in transport law. The Legal Counsel will work with the railway sector reform issues.

Duration and proposed timeframe:

Duration of assignment is 1 year (with discretionary extension for additional 1 year, also subject to availability of donor funding). 

This consultancy appointment is expected to start in November, 15, 2017 and has an estimated overall duration of 12 months. Subject to the availability of funding, the performance of the selected consultant and the specific needs of the RST, this appointment may be extended.

Main Duties and Responsibilities:

Facilitation of reform implementation process in the sector:

  • Legal support of the railway sector reform process
  • Preparation of draft bills and drafts of bylaws on amendments to current laws in the railway sector
  • Legal support of draft bills and drafts of the bylaws during their approval in the Ministries, Cabinet of Ministers, Parliament  and other state agencies
  • Drafting Ukrainian legal and sub-legal acts according to the EU-UA Association Agreement
  • Preparation of comparative analyses and tables of correspondence between Ukrainian and EU legal acts
  • Preparation of presentations and analysis of legal acts
  • Providing legal analysis of current legislation and preparation of propositions for its amendments within transport reform process
  • Participation in Governmental and other legislation working groups and ad hoc meetings.

Qualifications, Skills and Experience:

Qualifications and skills:

  • At least a Master’s degree in law from the reputable Ukrainian or foreign University
  • Strong analytical, communication and presentation skills
  • PC literacy (PowerPoint, Project, Excel, Word, Legal databases Liga or Rada proficient)
  • Experience in high-level negotiations, strong communication and presentation skills
  • Excellent command of English and Ukrainian, both written and spoken

General professional experience:

Preferably more than 10 years of general professional experience 

Specific professional experience:

  • Familiarity with the reform agenda in Ukraine
  • Experience in leading multidisciplinary teams is an asset
  • Experience in infrastructure sector is an asset

Assignment Value

The estimated monthly value of this consultancy position is in the region of EUR 1, 400-1,800

The funding source of this assignment is the EBRD-Ukraine Stabilisation and Sustainable Growth Multi-Donor Account. Please note selection and contracting will be subject to the availability of funding.

Selection Procedure

Following the evaluation of all applications received, selected candidates will be invited to a brief written test in [location] covering both general and technical questions in both English and Ukrainian. Short-listed candidates will be invited to interview.

The successful candidate will be required to provide a written professional reference (original in English, or Ukrainian with English translation) together with the contact details for two further referees who can attest to the professional and/or educational background of the candidate. Successful reference check will be a pre-condition to contracting.
